Sample User Agreement
about the rights to use the web portal
registrar information system qoldau.kz

1. Subject of the Agreement

This User Agreement (hereinafter referred to as the Agreement) on the rights using the web portal of the registration information systemqoldau.kz (hereinafter referred to as the Portal) is an adhesion agreement in accordance with Article 389 of the Civil Code of the Republic of Kazakhstan and is intended for settlement of relations between the joint stock company “Information and Accounting Center” (hereinafter referred to as the Registrar), with 100% participation state in the authorized capital administered by the Ministry Finance of the Republic of Kazakhstan according to the Government Decree of the Republic of Kazakhstan dated April 24, 2008 No. 387, and the User of the Portal (hereinafter referred to as the User), hereinafter collectively referred to as the “Parties”.

The user is any individual (individual entrepreneur) or a legal entity registered on the Portal and using it services and/or services of the Registrar.

This Agreement is a public offer. By accessing the Portal and its information services (hereinafter referred to as services), the User is considered having joined and accepted all the terms of this Agreement.

2. General provisions

2.1. The portal is a single access point for obtaining information and interactive services of the Registrar related to the registrar information system.

2.2. Registration on the Portal and its use are subject to acceptance and compliance by the User with the terms of this Agreement. Visiting this Portal and using its services, the User thereby agrees with terms and conditions of this Agreement. Registration on the Portal is free and voluntary.

2.3. The terms of the Agreement apply even if access to The portal is carried out outside the Republic of Kazakhstan, and also if access is carried out via a link that leads to the opening of the Portal. Administration of the Portal is carried out by the Registrar, authorized to including posting and exchanging information on the Portal.

2.4. This Agreement may be changed by the Registrar without any special notice.

2.5. If the User disagrees with the changes made, he has the right refuse access to the Portal and its services and stop using Portal and its services.

2.6. By signing this Agreement, the User thereby gives written consent to the Registrar for the collection, processing, storage, unloading and use of his personal data, trade secrets and other protected law of secrecy and information.

The User also agrees to the disclosure by the body of state income information constituting a tax secret, including information issued and received electronic invoices in accordance with Article 30 of the Code Republic of Kazakhstan “On taxes and other obligatory payments to the budget” (Tax Code)" for sending to the Portal for the purpose of using it services.

3. Rights and obligations of the Parties

3.1. The Registrar has the right:

3.1.1. if necessary, check the accuracy of the entered data The user, including by contacting government agencies and other organizations;

3.1.2. in case of violation by the User of the terms of this Agreement refuse User registration, delete or block the account User;

3.1.3. stop providing the User with access to the Portal by the grounds provided for in paragraphs 4.6, 4.7 and 4.8 of section 4 of this Agreements;

3.1.4. send informational notifications to the User in format of SMS messages and/or PUSH notifications;

3.1.5. receive a security token as a proxy for the User to obtain his personal data (information constituting commercial secret), including using state and non-state services for controlling access to personal data.

3.2. The user has the right:

3.2.1. receive consulting and practical assistance from the Registrar, in parts of using the Portal;

3.2.2. replenish the balance of your personal account on the Portal for payment services/services.

3.3. The registrar is obliged:

3.3.1. ensure the functioning of the Portal and its services;

3.3.2. do not distribute personal information about the User (personal data), except as provided by law Republic of Kazakhstan.

3.4. The user is obliged:

3.4.1. to receive the services of the Portal and its services:

1) have an IIN (for individuals and individual entrepreneurs) or BIN (for legal entities and individual entrepreneurs);

2) at the time of registration have a valid electronic digital signature (hereinafter referred to as EDS), issued by the National Certification Center of the Republic Kazakhstan;

3) go through the registration procedure.

3.4.2. provide the Registrar with accurate and complete information on the items, offered in the registration form on the Portal or when using it services;

3.4.3. do not take actions that could be considered as violating the legislation of the Republic of Kazakhstan or the norms of international rights, including in the field of intellectual property, copyright and/or related rights, as well as any actions that lead or may lead to disruption of the normal operation of the Portal and its services;

3.4.4. do not allow comments and other entries by the User on the Portal and its services, contrary to the requirements of the legislation of the Republic Kazakhstan and generally accepted norms of morality and ethics;

3.4.5. When working on the Portal, do not impersonate another person, do not use materials that contain viruses or other harmful software, do not write access passwords on media information, do not transfer received access identifiers to third parties, use your own digital signature;

3.4.6. do not use the Portal and information obtained on the Portal for the purpose of terrorism, extremism, incitement of ethnic hatred and other purposes prohibited by the legislation of the Republic of Kazakhstan.

4. Liability of the Parties

4.1. In case of violation of the terms of this Agreement, resulting in causing harm to all or one of the Parties to the Agreement, the guilty Party bears responsibility in accordance with the legislation of the Republic Kazakhstan.

4.2. The Registrar is not responsible for technical temporary failures and interruptions in the operation of the Portal and its services that arose due to reasons beyond the control of Registrar reasons, or in case of scheduled or unscheduled activities to maintain the Portal and its services.

4.3. The Registrar is not responsible for temporary failures and interruptions in operation of communication lines, other similar failures, as well as computer problems, mobile communication device from which the User accesses The portal and its services.

4.4. The Registrar is not responsible to the User for actions other Users and any other participants of the Portal and its services.

4.5. The Registrar is not responsible for any direct, indirect damage, including lost profits, damages from use, loss of data or any other intangible losses, damage to reputation and other damage User resulting from:

1) use or inability to use the Portal and its services By users;

2) changes in the terms of the Agreement by the Registrar.

4.6. The user bears full responsibility for the accuracy provided data when registering on the Portal, as well as for untimely updating and correction of data during use Portal.

4.7. The user bears full responsibility for failure to comply or improper fulfillment of its obligations under other agreements concluded with Registrar. In the event of such violations (failure to comply or improper fulfillment of its obligations under other agreements concluded with Registrar), the Registrar has the right to stop providing the User with access to the Portal.

4.8. The user assumes all risks and possible damage arising as a result of providing them with false information about themselves, as well as for transfer of own data and digital signature to third parties related to registration on the Portal and using its services.

5. Other

5.1. The Portal and/or the Registrar reserve the right to provide additional services to the User on a paid basis, which will be governed by other agreements.

5.2. This Agreement comes into force from the moment of registration User on the Portal and is valid for three years.

After three years, this Agreement is concluded for a new term.

I have read this Agreement and accept it as is, including all subsequent changes and additions to the Agreement.
